KUWAIT CITY, June 1: The Court of Appeals upheld the verdict issued by the Criminal Court to acquit a Kuwaiti girl who was accused of trafficking in cannabis and psychotropic substances “Tramadol and Methamphetamine”, and refrain from pronouncing punishment against her for the use of cannabis and psychotropic substances.
The court obligated her to maintain good conduct and behavior under a financial guarantee of KD 1,000, and not to return to drug use for a period of one year. It also ordered to place her under the supervision of an employee specialized in the aftercare department and to present herself twice a month to have samples taken from her to ensure she is not using drugs. According to the case file, the prosecution accused the citizen of possessing narcotic drugs, hashish, and psychotropic substances – tramadol and methamphetamine – with the intent of trafficking and abuse. In the merits of its ruling, the Court of Appeals affirmed that the accusation leveled against the girl was proven in terms of the use of narcotic substances and psychotropic substances.
The Public Prosecution did not respond in its appeal regarding the acquittal of the accused of trafficking in narcotic substances and psychotropic substances, which would change the aspect of the opinion in the appealed ruling, but merely stated that the accusation was proven. Therefore, the court decided on the matter to reject it and uphold the appeal ruling. During the court session, Lawyer Inam Haidar requested that the Public Prosecution’s appeal be rejected and that the ruling issued by the Court of First Instance confirming the invalidity of the arrest and search procedures and their consequences be upheld.
